Obtaining an Order of Protection

Our firm's attorneys have years of experience helping persons threatened by domestic violence obtain the protection of the law. Under Illinois law, actual violence such as an attempted assault or battery does not have to occur. A threat, intimidation, harassment, stalking, or interference with personal liberty is grounds for an Order of Protection. If you have experienced one or more of these, we can act quickly to obtain a temporary restraining order, and follow up by obtaining a permanent order. There are three basic types of orders of protection in Illinois:

Emergency Order of Protection — can be obtained almost immediately or within a few hours, without the presence of the person accused of the threat or act of violence. These last 14 - 21 days, specifically, until the hearing for the plenary order of protection.

Interim Order of Protection — can offer an additional period of protection, if for some reason the plenary hearing is delayed.

Plenary Order of Protection — issued after a court hearing in which the petitioner and the other party have the opportunity to tell their stories. It can last up to 2 years and be renewed.

Orders of Protection are available for persons in many types of relationships and former relationships, including spouses and ex-spouses, persons in dating relationships, same sex relationships, household members, roommates and other family members.
